1. Who we are and what these terms cover
These terms govern the relationship between HidraNet, Lda, Lisbon, Portugal, registered at address to be added, company number company number to be added ("HidraNet", "we"), and anyone who uses HidraNet software and services ("you").
They apply to HidraNet Browser, the HidraNet node, the HidraChat, HidraMail, Forum, HidraSearch and SevenNine applications, this website and any paid plans: together, "the Services". By using the Services, you accept these terms and the Privacy Policy.
2. The software is free
HidraNet's code is published under the MIT licence. These terms do not restrict any right the MIT licence gives you: you may use, study, modify and redistribute the code under the licence's conditions. These terms govern the Services HidraNet provides, such as distributed builds, updates, this website and paid plans.
3. Age and capacity
You must be at least 16 to use the Services. If you act on behalf of a company, you confirm you are authorised to bind it.
4. No account, just keys
The Services require no account. Your .hidra addresses and mail addresses are key pairs generated on your computer. You alone are responsible for keeping them safe: HidraNet does not know them and cannot recover them. If you lose them, you lose control of the corresponding addresses.
5. Acceptable use
You agree to use the Services in accordance with the law. In particular, you will not use them to:
- distribute child sexual abuse material, or any content or trade that is illegal where you or the recipient are;
- commit or prepare fraud, extortion, malware distribution or attacks on systems you do not own;
- harass, threaten or incite violence against anyone;
- sell or advertise illegal goods or services, including on shops listed in HidraNet's directories.
Breaching these rules may lead to the removal of content from spaces HidraNet manages and, where the law requires, to reports to the authorities.
6. Your content
What you publish, send or create through the Services remains yours. For the Services to work, you grant HidraNet and other network participants the permission strictly necessary to transmit, route and temporarily store that content, encrypted where applicable. This permission ends when the content stops circulating.
You are responsible for what you publish. Forum posts and published .hidra sites can be seen by anyone.
7. Moderation and reporting illegal content
HidraNet does not see the encrypted content circulating on the network. In the public spaces it provides, such as the Forum and the HidraReview directory, moderation tools allow content that breaches these terms to be hidden or removed.
Anyone may report content they consider illegal in a space managed by HidraNet to legal@hidranet.org, stating the exact location of the content, why they consider it illegal and how to reach them. We handle each report diligently and communicate the decision.
8. Third-party services
The Services use and connect to services HidraNet does not control, including the Tor network, public message brokers, search engines and the Solana network. Their use is subject to their operators' terms.
9. Paid plans and HNET
9.1 Paid plans
When paid plans are offered, their features, price, billing period and taxes will be shown before payment. Subscriptions will renew at the end of each period until cancelled, which you may do at any time, effective at the end of the period already paid.
9.2 Right of withdrawal
If you are a consumer in the European Union, you may withdraw from a paid contract without giving a reason within 14 days of subscribing, under Portuguese Decree-Law 24/2014. If you expressly ask for the service to start immediately and acknowledge that you thereby lose the right of withdrawal, that right ends once the service has been fully performed.
9.3 Business customers
Services for businesses are governed by their own contract, which prevails over these terms in case of conflict.
9.4 HNET
HNET is HidraNet's community token on Solana, described in the HNET token whitepaper. These terms confer no rights in HNET. HNET gives no claim on HidraNet, its assets, revenue or profit, and HidraNet makes no promise about its price. Transfers on Solana are final: HidraNet cannot reverse, refund or recover HNET sent to any address, including the support wallet.
10. Availability and changes
The Services depend on a distributed network and on third parties, and may be temporarily unavailable. We may change, add or remove features. If we remove a feature included in an active paid plan, we give reasonable notice and, if the change harms you, you may cancel with a pro-rata refund.
11. What HidraNet does not guarantee
Anonymity on the internet is never absolute. HidraNet substantially reduces the information exposed about you, but does not protect against compromise of your own computer, against an adversary able to observe both the entry and the exit of a circuit at once, or against what you reveal yourself. The known limitations of each version are published in the Technical Whitepaper and in the release notes.
To the extent permitted by law, the free Services are provided as they are. Nothing in these terms excludes the rights the law gives you as a consumer, in particular under Portuguese Decree-Law 84/2021 on the conformity of digital content and services.
12. Liability
HidraNet is not liable for indirect damage, loss of profit, or loss of data resulting from the loss of your keys. For paid plans, HidraNet's total liability is limited to the amount paid in the twelve months before the event giving rise to it.
These limits do not apply in cases of wilful misconduct or gross negligence, harm to life or physical integrity, or wherever the law does not allow liability to be limited.
13. Intellectual property
The MIT licence covers the code. The HidraNet name, logos and visual identity are distinctive signs of HidraNet, Lda and are not part of the code licence. You may refer to HidraNet by name to describe the project.
14. Suspension and termination
You may stop using the Services at any time. We may suspend access to a paid plan or to a space managed by HidraNet in case of a serious breach of these terms, stating the reason unless the law prevents it.
15. Governing law and disputes
These terms are governed by Portuguese law. If you are a consumer, you keep the protection of the mandatory rules of your country of residence and may go to the courts of that country.
For consumer disputes, you may turn to the Lisbon Consumer Arbitration Centre (www.centroarbitragemlisboa.pt) or another competent alternative dispute resolution body; the full list is on the Portuguese Consumer Portal (www.consumidor.gov.pt). HidraNet provides the Electronic Complaints Book (www.livroreclamacoes.pt).
16. Changes to these terms
Each version is published with a date. If a change is significant, we give at least 30 days' notice on this website. If you do not agree, you may cancel a paid plan before the change takes effect.
